When the catcher catches a foul ball behind the plate is the batter out or does it matter what the count is?

If a batter swings, and the ball becomes a fly ball, and that ball is caught by ANY fielder (including the catcher) before it hits the ground; the batter is out no matter what the count happens to be or whether the ball is fair or foul. MLB Rule 2.0 states that "A FLY BALL is a batted ball that goes high in the air in flight." No specific rule exists on what "high in the air" means it's entirely the judgement of the umpire.
If the batter swings and partly hits the ball but the ball "goes sharp and direct from the bat to the catcher's hands and is legally caught" (again, MLB Rule 2.0), that is a foul tip. If the catcher does not catch the ball partly hit by the bat, the umpire can rule that the ball was a foul meaning the batter is NOT out if there are two strikes on him. The umpire can also rule that the ball was not hit by the bat meaning the swing was a strike and the batter is (again) out if there are two strikes on him.

It depends on where the ball is when the catcher catches it. The fact that the ball hit the plate does not matter one bit. It doesn't even matter where the catcher himself is when he catches it. If the ball is in or over fair territory it is fair, if the ball is in or over foul territory it is foul.

Yes. A dropped foul ball can be considered an error if the official scorer deems that the player should have caught the ball. The batter will not reach base in this case. On "catcher interference", the batter is awarded first base, no official at-bat is charged (as it is notated in the box score as "'Joe Blow' awarded first base on catcher interference) and the catcher is charged an error.

What is a pitch out in softball?
A pitch out is another term for intentionally walking a batter. What that means is the pitcher will pitch four balls(not strikes) in order to put the batter on base without giving her a chance to hit. The batter will only get to first base unless she steals or gets hit around in a later situation. The reason for this is normally when the batter is a very good hitter and the pitcher would rather give the batter after her a chance to hit so that a run isn't scored. Pitch outs are thrown very far out from the strike zone. The pitcher will throw only at 70 mph (not exactly- around that speed) while the catcher stands up and out of the way to catch it. A pitch out is a term for intentionally throwing a ball to the outside of the plate (where the batter cannot hit it) because you believe that the runner (usually on first) is going to try to steal a base. The pitch out allows the catcher to stand up as soon as the pitch is thrown and be in a throwing position as soon as he/she receives the ball. This allows the catcher to get the ball to the the target base very quickly and can greatly improve the chances of throwing out the runner. An intentional walk is when the pitcher intentionally throws four balls to put the runner on first. There are a number of situations where a team may want to do this. Example: there are runners on second and third and you want to setup a force play at home plate. In this case you would intentionally walk the batter.

When does it matter? A dropped third strike only matters when first base is unoccupied OR there are two outs. If there is a runner on first base and less than two outs, then a dropped third strike doesn't matter and the batter is out. What can the batter Do? What if the runner at first is stealing? If there are less than two outs, it doesn't matter. Even on an attempted steal, first base is considered occupied and the batter is out. What happens when there are two outs? When there are two outs the same rule applies with the addition that first base can be occupied. In this situation a force play can be created on other bases in addition to either tagging out the batter or throwing him out at first. Example: Bases loaded, two outs. Catcher drops the third strike. A force play has now been created at all bases as all runners must try to advance. Catcher can simply step on home plate for the force at home and third out. He doesn't have to make the out on the batter. What if a runner crosses the plate before the batter is thrown out at first or tagged? The run does not count. Example: Runner on third, two outs. Catcher drops the third strike, while he is picking it up and throwing to first, the runner from third crosses home plate. As long as the catcher throws out the runner at first, the run doesn't count. The force play at first is the same as if a ground ball was hit to another infielder. The run doesn't count.
