but in answer to your question its not intended to be used as a weapon

but if you use it as one it is same with anything

for example a Mc Donalds Straw is intened for drinking but there are over 300 ways to KILL someone with it if you know how

No, not without a preexisting condition. Paintball guns, even over FPS limit of 300 feet per second, can only break the skin. If you have certain conditions for heart attack, any trauma to the chest may trigger one. A shot to the eyes will blind you, a shot to the Adams apple may "knock the wind" out of you, and repeated shots to the gentiles may cause infertility, but there is no feasible way for someone to kill an average human with a paintball gun.

Unless you use ammo that is lethal. Or not intended to be used in a paintball gun. One can easily load different kinds of improvised ammo into the barrel. This could be stupid when done on the field and potentially be dangerous.

No. Paintball guns are used as nonlethal (less than lethal) tools by law enforcement No matter how fast you turned up your gun, the paintball would not kill someone on impact. If someone had a pre-existing condition, like a heart weakness, then the paintball gun, like the taser, rubber gun, and riot gas could be lethal.

Really this depends on where you are, some countries consider them weapons and some do not. Most countries do not but often, like in Mexico for example, you have to jump through a few hoops still. In the US they are not considered weapons unless using in a crime

No a paintball is not considered a firearm. Which is why a felon can purchase a paintball gun. Though just because it is not a firearm, this does not mean it can be taken into public.
