"Gear" today can mean two different things. In engineering/tech speak a gear is a gear ratio, a way of trading speed for strength or the other way around. "Gear" in everyday language often means "stuff", or "equipment". Like fishing gear(rods and lures), sports gear etc.
In tech speak the best gear is the one where you can pedal most efficiently. For a longer ride this usually means keeping the cranks turning at a rate of 80-100 turns/minute.
A question about "best equipment" can't be answered, as there's too much personal preference involved in that.

Pretty much whatever you want. A helmet is always a good idea, as are good shoes(no flip-flops or barefoot).
For a casual ride, just wear whatever is comfortable for the weather and temperature.
For a more strenuous ride, tight-fitting, sweat-wicking sports clothes are nice. For longer rides, special, padded bike shorts are nice.
Depends on the weather, and what kind of riding I'm doing. If I'm riding hard, I'll wear tight fitting, wicking clothes to keep comfortable as I sweat. If I'm just pottering around I'll weare whatever I'm already wearing. Maybe add helmet, cycling shoes and gloves if I can be bothered.
a full face helmet is compulsory googles, shin guards, knee guards, fore arm guards, elbow pads body armor and shoulder pads.

Failure to wear a helmet while biking may require a fine.
You use the muscles in your body.
The New York DWI laws do not apply to vehicles powered by "muscular power". To my knowledge, there is no separate crime called "biking while intoxicated".
Depends on where you're at, and if you're OK with paying the fines or not. Some places do have mandatory helmet laws, some have them for kids/teens. Other places, it's still free.
