Yes, and in fact in almost all states you will need a motorcycle license and not just a moped license, as a Moped is generally considered to be a cycle with a 50cc engine or smaller. It also needs to be registered with the DMV and pass an inspection (some states do not require inspections, however - you'll need to check for yourself) AND you need to carry liability insurance to be able to LEGALLY ride it on the roads. NO! Mopeds generally are 50cc or less. Some states allow highway travel with a minimum of 150cc which is suicidal, unless it can maintain 70mph. Personally I would go no less than 250cc for highway riding, and more like 400cc for long distance touring with or without a passenger and with the ability to pass comfortably at highway speeds.

no not all of them, i have a 2012 motofino 50CC and it didn't have it but they do have rev limiters in the CDI, the stock carbs that can't be adjusted are set to burn lean to pass EPA guidelines, some have restrictors on the exhaust gasket.
