Nothing states that the umpire must warm a team for throwing the bat. Most the time this is done, much like you would warn a team to slide on close plays, however, in this question. I have never seen a scenario where the bat was thrown and hit another player and only a warning was given. This should be an automatic out, as it is a rule that is generally made very clear and the warning is given the first time as a "no harm, no foul" warning --- but if the bat actually hit someone.. well then there is some harm...
