The rules of the road state that the sailboat stands on & the power boat gives way, but survival may mean giving way no matter who is "right".

The main rules are as follows:1. Avoid collisions at all cost (even if you've the right of way, you can be penalized for not doing everything possible to avoid a collision)2. If a powerboat is about to cross paths with a sailboat under sail give way, the sail boat is the stand-on vessel, therefore you are the give-way vessel and need to move accordingly.
Assuming both boats are under sail, and both boats have adequate visibility, the position of the wind will determine which is the stand-on vessel and which is the give-way vessel. If each vessel has the wind on a different side, the one with the wind on the port side keeps clear. if both have the wind on the same side, the vessel nearest to the direction of the wind keeps clear.
A sailboat under sail should never give way to a motor boat. However, if it comes up against another sail boat: 1. Overtaking boats must give way 2. Those on Starboard tack have right of way 3. The boat that is closest to the wind (or on the windward side) should give way

The sailboat is the give-way vessel when it is overtaken by the motorboat, which is generally considered the stand-on vessel. Additionally, when both vessels are on a collision course and the motorboat is to the right (starboard) of the sailboat, the sailboat must give way. In situations where both boats are under sail, the sailboat must also give way to a motorboat if the motorboat is not under command.
