It is down to the officials, the linesmen normally making the decision if it goes over the sideline. Usually there is no doubt about who gets it, so rarely do the officials actually have to formally impose a decision.
Out of bounds in basketball is passed the line at the end of the court. If a person with the ball stands out of bounds the other team gets the ball. Someone on Team A is on offence (they have the ball) and someone on Team A knocks the ball out of bounds, Team B gets the ball. But if Team A was on offence and Team B knocks the ball out of bounds, Team A keeps the ball.

Like any referee, they make sure the game is being played by the rules. They are the judges as to whether or not a play is fair, and who gets the ball after it goes out of bounds.
If the opponent has established position out of bounds (at least one foot on the floor) then the ball would still be yours. If the opponent is in the air and has not established position out of bounds the ball is still live.

Whoever gets to the ball first. :-) A backward pass (i.e., a lateral) that is not caught is a live ball, and any player from either team may recover it. If it goes out of bounds, the ball is spotted at that point.
They are signifying to the referee when or if the ball went out of play that it was kicked out by the opponent and their team should get possession. When the ball goes out of bounds the referee raises the flag he holds pointing in the direction the team who gets possession is trying to score. They may also do it to appeal for an offside.
