Some briefs or athletic shorts which are made to hold a cup do not hold the cup tight against the body. To ensure a tight fit, you can wear compression shorts over the cup-jockstrap or over the briefs or shorts.

You can add a cup to a jock in order to protect your testicles from injury from balls, e.g. when playing baseball. So the purpose of the jockstrap is really to protect your testicles--so your testicles MUST be in the pouch for it to do any good. Your penis thus has to be in the pouch, too, but that's incidental since it is not liable to get injured.
